A federal court of appeals yesterday enjoined the Centers for Medicare & Medicaid Services (CMS) from awarding new contracts for the recovery auditor contractors (RAC), pending an appeal by incumbent RAC CGI to the court of appeals in the federal district. Monitor Mondays legislative analyst Emily Evans, a partner at Obsidian Research, estimates that process is likely to take 12 months. Evans speculates that CMS might forego the current procurement process while the court reviews the CGI case. She also expects that CMS will extend active auditing for another year with the incumbent RACs. Details to follow.
